Risks of getting married in the United States with tourist visas

Our company has received many inquiries about attempting to get married in the United States with tourist visas while being blocked at the U.S. Customs and being sent back home. This situation has aroused our great attention, and we feel it is necessary to remind clients who have this idea again.

We do not recommend that clients to get married in the United States with tourist visas, because it is risky:

1. There is a high rejection rate for single/divorced persons to apply for tourist visas, especially for applicants with poor English, it is difficult for visa officers to believe that they are capable of traveling to the United States alone.

2. When entering the United States, it is easy for experienced immigration officers to see that you have an attempt to marry and immigrate to the United States, resulting in being sent back to your home country at the airport. If you are lucky to encounter a kind immigration officer, you may be allowed to "Withdraw Application for Admission" and to return to your home country on the day or the next day after you buy your ticket; If you encounter a stringent immigration officer, you will be issued a "Notice and Order of Expedited Removal" immediately, with the accusation that "provided false information to defraud tourist visas", and you would be forced to board a plane. In the latter case, the consequences will be extremely serious and will result in a ban on entry for 5 years or more. In this way, when you apply for K1 visa or immigrant visa in the future, the visa officer will refuse to issue the visa. If you want to obtain a visa, in accordance with the requirements of the US immigration law, you must apply for a waiver from USCIS, and get the approval before obtaining the visa. In either case, when you are blocked by the immigration officer at the customers, according to the procedures, the immigration officer will conduct inquiries and make notes. The problems are mostly inducing and extremely detrimental to you. If you answer the questions carelessly, the crime of "fraud (obtaining a tourist visa)" will be established, which will have a serious negative impact on future applications for immigrant visas, K visas, or applications for waivers.

3. Even if you were lucky enough to get a tourist visa and entered the United States, when you apply for green card after getting married in the United States, the immigration officer will still suspect that your motives in applying for a tourist visa were not pure. If they think your motive for marriage is in order to stay in the United States, your green card application will be rejected.

4. If your marriage partner is a permanent resident (green card holder) of the United States, it's very risky to waiting for immigration process in the United States. The stay period of tourist visas is normally 6 months, and your tourist visa would expire during the waiting period. If your unlawful presence in the United States exceeds half a year, you won't be allowed to enter U.S. for 3 years. If your unlawful presence in the United States exceeds a year, you won't be allowed to enter U.S. for 10 years.

Again, the risk of going to the United States with a tourist visa to get married is not worth it, please be careful!
